Terms of Service

1. Agreement to Terms

By accessing or using IronClaw ("Service"), operated by Fifth of Fifth Technologies ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

IronClaw provides a hosted AI assistant platform that connects to messaging channels including WhatsApp, Telegram, Discord, Slack, and others. The Service includes a web dashboard, API gateway infrastructure, and integrations with third-party AI providers.

3. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately at hello@ironclaw.app if you suspect unauthorized access.

4. Billing and Payment

Paid plans are billed monthly in advance via Stripe. All fees are non-refundable except where required by law. We may change pricing with 30 days' notice. If payment fails, we may suspend your account until the balance is resolved.

5. Bring Your Own Key (BYOK)

You may provide your own OpenAI API key. When using BYOK, you are subject to OpenAI's terms of service and usage policies in addition to ours. We encrypt your API key at rest but are not liable for charges incurred on your OpenAI account.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Send spam, unsolicited messages, or bulk automated messages
• Attempt to gain unauthorized access to other accounts or systems
• Distribute malware or harmful content through connected channels
• Resell or redistribute the Service without written permission
• Violate the terms of any connected third-party platform

7. Content and Data

You retain ownership of all content you send through the Service. We do not use your messages or data to train AI models. We may store conversation data to provide the Service and may delete it upon account termination.

8. Third-Party Services

The Service integrates with third-party platforms (OpenAI, messaging providers, Stripe). Your use of those platforms is governed by their respective terms. We are not responsible for the availability, accuracy, or policies of third-party services.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications at any time. We are not liable for any downtime or data loss.

10. Limitation of Liability

To the fullest extent permitted by law, Fifth of Fifth Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may cancel your account at any time from the Settings page. We may suspend or terminate your account for violation of these terms. Upon termination, your data will be deleted within 30 days.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
